Terms Of Use

Brain Injury Lawyers is the trading name for DM Claims Limited, authorised and regulated by the Financial Conduct Authority (FRN 1005543).

In these Terms, “we”, “us”, and “our” refer to DM Claims Limited, and “Website” means the Brain Injury Lawyers site at brain-injury-lawyers.co.uk, including all pages and features under that domain.

We are not a law firm, and we employ no solicitors or lawyers. We connect people and families affected by brain injury with independent solicitors from our panel of specialist firms across the UK.

DM Claims Limited is the data controller for personal data collected through the Website. Please read our Privacy Policy and Cookies Policy for details about how we handle your information and cookies.

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

What our service covers

Our service helps you connect with a suitable panel solicitor who may be able to assist with potential claims involving, for example, car or road traffic accidents, workplace incidents, clinical negligence, or accidents in public places. Any legal work is provided only by the independent panel firm that chooses to assist you and that you choose to instruct.

Submitting an enquiry does not mean a panel firm will take on your case. A lawyer–client relationship is formed only when a panel firm confirms in writing that it acts for you under its own terms of engagement.

We are not a party to any agreement between you and a panel firm and are not responsible for the legal advice or services provided by any panel firm.

Using the Website

By accessing, browsing, or submitting an enquiry on this Website, you agree to these Terms of Use and the policies they incorporate, including our Privacy Policy, Cookies Policy, and Regulatory Information page; where we request consent for non-essential cookies, you can manage your preferences at any time, and if you do not agree to these terms or policies, you must not use the Website.

The Website is intended for residents of the United Kingdom who are 18 or over (or using the site with a parent/guardian).

Information on the Website

Content on the Website is general information only and not legal advice. Any figures or examples (including compensation ranges) are illustrative and depend on the facts and evidence of each case. Outcomes are not guaranteed.

If the Website mentions options such as “No Win, No Fee”, this relates to funding arrangements that may be offered by panel firms, subject to their assessment and terms. The panel firm will explain costs and funding before you decide how to proceed.

Your responsibilities

You agree that information you provide is accurate and not misleading. You must not:

  • use the Website for unlawful, defamatory, or misleading purposes;
  • attempt to gain unauthorised access to the Website or our systems;
  • introduce viruses, malware, or other harmful code;
  • use automated scraping, data mining, or similar techniques without our written consent;
  • do anything that could impair the operation or security of the Website.

Intellectual property

The Website and all content, text, graphics, logos, and design are owned by or licensed to DM Claims Limited. All rights are reserved. You may print or download content for your personal, non-commercial use only. You must not copy, reproduce, distribute, adapt, or create derivative works without our prior written consent, except as permitted by law.

Third-party sites and tools

The Website may contain links to third-party websites or tools (including analytics or live chat services). We do not control and are not responsible for their content, policies, or availability. Use of third-party sites or tools is at your own risk.

Availability and changes

We aim to keep the Website available and up to date, but we do not guarantee it will be error-free, complete, or uninterrupted. We may change, suspend, or withdraw any part of the Website at any time.

Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015.

To the extent permitted by law, we are not responsible for any:

  • loss of profit, revenue, business, or anticipated savings that was not reasonably foreseeable;
  • loss of data or goodwill; or
  • indirect or consequential loss that was not reasonably foreseeable.

We do not exclude or limit liability for loss or damage caused by our failure to perform our obligations with reasonable care and skill, or for breach of terms that the law says must be included in these Terms.

Complaints about our service

If you wish to complain about our Website service, contact [email protected]. We will acknowledge your complaint promptly and aim to provide a final response within the time frame required under the Financial Conduct Authority’s Dispute Resolution: Complaints sourcebook (DISP). If you are dissatisfied with our final response, or if you have not received one within the period specified by DISP, you may be able to escalate your complaint to the Financial Ombudsman Service (FOS). Details of how to do this will be provided in our final response and can be found on the FOS website.

Complaints about a panel firm’s legal services should be made to that firm under its complaints procedure. Where applicable, the panel firm will explain any right to escalate to the Legal Ombudsman or relevant regulator.
